FTCA Program

Under the Federal Tort Claims Act (FTCA), free clinics can be deemed by the Health Resources and Services Administration, Bureau of Primary Care to provide malpractice immunity.

TFC was only the 4th free clinic in NC and the 73rd in the US to be deemed under FTCA.  Thus, TFC can offer clinical volunteers complete immunity from malpractice claims during their services as a TFC volunteer.  Establishing coverage under FTCA included initiating Peer Review and Quality Assurance programs to ensure the highest quality of care.  TFC currently has 43 practitioners covered under the FTCA program.  Staff and board members are also covered under FTCA.

In order to be covered by FTCA, professional volunteers must submit appropriate paperwork (similar to a hospital privileging process), be approved by TFC’s Volunteer Medical Director and Board of Directors, and finally be deemed by the US Health Resources and Services Administration.
